With an exceptional reputation built over four-and-a-half decades and the recipient of numerous awards and honors, Ernest Malone provides insightful management-side guidance on a wide range of labor and employment issues. Ernie collaborates with employers in strategic planning on workforce-related matters such as compensation and benefits. In addition to keeping clients in compliance with employment and antidiscrimination regulations, he also directs them in developing and administering sound employment practices and policies.

Ernie advocates for employers in litigation stemming from an array of federal statutes, including Title VII of the Civil Rights Act, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA) and the Family Medical Leave Act (FMLA), as well as state employment laws in jurisdictions across the country. In all legal procedures with adversarial parties, Ernie remains calm, stays firm in his position, pays attention to details, and maintains his respectful and affable nature with opposing counsel, witnesses, judges, and juries alike.

Businesses embarking on mergers, acquisitions, and divestitures rely on Ernie to perform comprehensive due diligence, identify and mitigate potentially problematic personnel issues, and pave the path towards successful transactions. On the labor side, he counsels clients grappling with union formation issues and National Labor Relations Board (NLRB) elections. Ernie also represents management in collective bargaining, arbitrations, and the administration of labor contracts. He has been a contributing author to The Developing Labor Law, published by the American Bar Association.

Ernie’s clients operate in a broad spectrum of industries, including banking, communications, construction, energy, health care, hospitality, transportation, manufacturing, and technology, among many others. No matter what type of organization he advises, Ernie collaborates closely with the client’s team to get to know their business dynamics in depth. This familiarity enables him to mount highly effective defenses in disputes and also help them optimize opportunities in a very challenging and rapidly evolving employment environment.

Frequently conducting both on-site and remote training sessions and seminars, Ernie keeps supervisors and managers up to speed on employment law compliance, effective employee relations, human resources administration, and other topics.
