Employment Matters and Discrimination Law
Our attorneys are engaged in the defense of our clients'
interest in all areas of discrimination law. This involves
jury trials, administrative proceedings, bench trials,
and arbitrations under Alternative Dispute Resolution
procedures. Our attorneys provide a planned strategic
defense in all areas of litigation including discovery,
motion pleadings, trials, appeals, and settlement discussions.
The firm represents management before federal and state
district courts and appellate courts, state supreme courts,
and the United States Supreme Court. Besides defending
our clients' interests in active cases, we train management
and staff in effective ways to supervise and discipline
personnel so as to minimize exposure to discrimination
and wrongful action claims, while at the same time achieving
business goals. In an attempt to prevent the escalation
of personnel problems into lawsuits, our attorneys assist
our clients in developing procedure, policy, and rules
dealing with employee conduct, communication systems,
complaint handling, and other employee relations policies.
Attorneys strive to develop positive employee relations
practices in all employment settings while representing
management's business goals.
Labor Law and Unions
We represent clients with both union and nonunion workforces.
We assist our unionized clients with matters involving
collective bargaining, grievance handling, arbitration
hearings, and working within the framework of a union
contract. We also assist unionized companies involved
in strikes, boycotts, and corporate campaigns. For our
nonunion clients, the firm has developed successful legal
strategies to resist union organizational attempts. These
strategies include assisting managers in the development
of education programs emphasizing the benefits of remaining
nonunion and the possible downside to being represented
by a labor organization. For both union and nonunion clients,
we handle matters before the National Labor Relations
Board, including unfair labor practice proceedings, representation
case hearings, and all other administrative procedures.
Human Resources Administration
Our attorneys develop individualized personnel policies
and procedures for many industries and levels of staffing.
We counsel management on interviewing, hiring and training
employees; employment contracts; employee reviews; record
keeping requirements; incentive programs; and on restructuring,
downsizing, and termination procedures. Our attorneys
assist in the development and maintenance of compensation,
pension, and benefit plans. We also advise on the recruitment
of foreign employees in compliance with work visas and
immigration regulations.
Our in-house consultant, Carl F. Morley, works with our
attorneys to develop policy manuals, compensation programs,
and affirmative action plans for our clients. With legal
counsel, he develops EEO studies, substance abuse policies,
employee opinion surveys, and conducts HR audits.
Management Training Seminars
The firm is committed to providing thorough and ongoing
training of administrative and supervisory personnel.
Our goal is to integrate laws, regulations, business needs
and the workforce into a fully functioning and compliant
organization. To keep our clients updated on recent developments,
we publish a monthly newsletter and a health care newsletter.
We are always available to provide training on-site and
we regularly host seminars in New Orleans on topical and
relevant issues.
